The apex court which was hearing a petition filed by advocate Ashwini Upadhya stated that  “the Union of India is unprepared”. Mr Ashwini Kumar Upadhyay has asked the apex court to declare provisions of the Representation of the People Act which includes the prohibition of participation in the election for the bar convicted politician for six years after serving jail terms.

The Supreme Court bench headed by Justice Ranjan Gogoi showed disappointment and said that govt is “unprepared” and said that “The government is compelling us to pass certain orders which we do not want to at this stage ”

The bench examined the additional affidavit filed by govt which stated that they had proceeded the formalities for the special court and had released funds to 11 states to set up 12 such special courts. The centre even answered the question raised by the apex court regarding the cases pending before the special courts. The Centre said that Ministry of Law and Justice  was “regularly taking up the matter with the concerned authorities for furnishing the information regarding the cases transferred/disposed of/pending in the said court(s)”

On December 14 last year, the Supreme Court ordered the centre to set up 12 special courts which can exclusively deal the cases filed against the corrupted politicians and it asked to start the hearing from the March 1 this year.

On August 21, the apex court asked about the steps taken for the set up of the special court. The affidavit filed by the Centre stated that two special courts were to be set up in Delhi and one each in Andhra Pradesh, Telangana, Karnataka, Kerala, Tamil Nadu, Bihar, Uttar Pradesh, West Bengal, Maharashtra and Madhya Pradesh.

The bench shifted the hearing of the matter on September 12. The formation of the special court for the corrupted politician will end up the sequences of crime done by the politician under the shadow of govt.
